Is CBD Legal in Rhode Island? Rules, Age Limits & Safety

CBD is not automatically illegal in Rhode Island, but a product’s THC content, how it is sold, and its label matter. As of October 05, 2026, federal law treats hemp with no more than 0.3% delta-9 THC by dry weight differently from marijuana, while the rules for CBD foods, supplements, and cannabis dispensaries are not the same.

What does the federal hemp rule actually mean?

The 2018 Agriculture Improvement Act (the 2018 Farm Bill), signed December 20, 2018, removed hemp from federal controlled-substance rules when it contains no more than 0.3% delta-9 THC on a dry-weight basis. The FDA’s cannabis guidance explains that this definition covers the plant and its derivatives, extracts, and cannabinoids.

That federal definition is not a blanket approval for every CBD item on a shelf. The FDA says CBD may not legally be marketed as a dietary supplement, and CBD added to food may not legally be sold in interstate commerce. This is why a hemp-derived CBD oil, a CBD gummy, and a THC cannabis edible can face different rules even when people casually call all three “CBD.”

What Rhode Island rules should you check before buying?

Rhode Island’s cannabis framework is commonly identified with R.I. Gen. Laws § 21-28.6. State cannabis labeling material describes retail marijuana products as requiring product information such as the estimated THC and CBD amount, ingredients for edibles, safe-storage directions, and warnings. It also describes child-resistant, opaque, light-resistant, tamper-evident packaging for retail marijuana products.

For the current state position on a specific product, check the Rhode Island Department of Health cannabis guidance before you order or visit a shop. That is especially important for gummies, drinks, vapes, delta-8 products, and anything with THC.

Can anyone buy CBD or shop at a dispensary?

Do not assume that a CBD shop and a cannabis dispensary follow the same rules. The Rhode Island labeling rules reproduced for medical marijuana include a warning that products are for adults 21 and older, while medical products may have patient-only requirements. Ask the dispensary whether it serves adult-use customers, medical patients, or both, and bring the identification it requires.

For a hemp-derived CBD product outside a dispensary, confirm the retailer’s age policy and ask to see the product label before paying. A useful label check includes:

  • the amount of CBD and THC per serving and per package;
  • a batch or lot number;
  • an ingredient list for gummies or other edibles;
  • clear storage and age guidance; and
  • the product’s test report, matched to that batch when available.

Are CBD gummies legal to buy in Rhode Island?

Be more careful with gummies than with a simple “hemp legal” claim. The FDA says CBD cannot legally be added to food in interstate commerce, and gummies are food-like products. A Rhode Island retailer may have its own rules and may sell products under state cannabis rules, but you should confirm the item’s THC content, its intended market, and the retailer’s age requirement before buying.

Keep any THC-containing edible away from children. The CDC’s cannabis safety guidance warns that edibles can create a higher risk of unintentional poisoning and recommends keeping cannabis products locked up and out of children’s sight and reach.

What about delta-8, THC, and products labeled “hemp”?

“Hemp” does not tell you everything you need to know. CBD by itself is not impairing, but THC can be. Delta-8 THC is intoxicating, and the FDA’s delta-8 consumer update says these products have not been evaluated or approved for safe use. It also warns that delta-8 gummies and similar products can be confused with ordinary candy.

Do not drive after using an intoxicating cannabis product. The CDC says cannabis can slow reaction time, impair coordination, and affect decision-making.

What should you know about CBD safety?

CBD is not the same as THC, but “non-intoxicating” does not mean risk-free. The FDA says CBD can cause liver injury, interact with medicines, and contribute to drowsiness, diarrhea, appetite changes, irritability, or agitation. Talk with a clinician or pharmacist before combining CBD with prescription medicines, alcohol, or medicines that make you sleepy.

The NIH’s cannabinoid overview also notes that over-the-counter CBD products can contain a different amount of CBD than their labels state and may contain THC or contaminants. If you are buying a gummy, treat a clear, batch-specific label as basic consumer protection—not a promise of a health result.

Do Rhode Island dispensaries take cash, and how many are there?

Payment methods and store counts can change quickly. Call the specific dispensary before you go and ask whether it accepts cash, debit, or another payment method, whether it serves adult-use customers, and whether it carries the type of product you want. The same call can save you a wasted trip if you need a medical-patient purchase instead.

Which states have legalized CBD?

There is no single, simple 50-state answer because states regulate hemp, CBD foods, cannabinoid products, medical cannabis, and adult-use cannabis differently.
